Submitting an application for a trademark

Putting in an application for brand name registration
The registration application can be submitted electronically (form TM-A) or manually. In major Indian cities like Delhi, Mumbai, Kolkata, Ahmedabad, and Chennai, you will need to personally carry and deliver your application for registration to the Registrar Office of TradeMarks if you choose manual filing. After then, you have to wait for the acknowledgement for at least 15 to 20 days. In the event of an e-filing system, however, you will instantly acquire your receipt of acknowledgement on the government website.
Analyzing the brand name application process.
The Registrar of Trademarks will examine the application once it is filed to determine whether you met certain conditions and whether your brand name complies with the law as it stands. Additionally, the identification must not resemble any current brand that is awaiting registration, either visually or phonologically.
Your brand being published in the Indian Trade Mark Journals.
After the examination process, the Registrar of Trademarks will accept and publish the brand name in the Indian trademark journal if the registry does not object (the time frame may vary). This is arguably the most important part in registering a trademark. Any third party may contest the immediate application within four months of the journal’s publication date if their brand name and the brand name in question are identical. The Trademark Registration Certificate will be issued by the Registrar of Trademarks if no opposition is filed within that time frame.
Refusal to use a trademark.
Let’s say a third party objects within four months (the exact time frame may differ) of the trademark being published in the trademarks journal. In that scenario, the Registrar of Trademarks will send you with a copy of the opposition notice. You have two months to file a counter-statement in response to the opposition notice. The trademark application will be deemed abandoned and denied if the counterstatement is not filed within two months. Both parties must pay the Rs. 2700 government charge at the time of filing for both the Notice of Opposition and the Counterstatement.
Let’s say, then, that no complaint is raised within the allotted three months. If so, you will not be subject to this process, and a Trademark Registration Certificate will be issued under your brand name.
Trademark Opposition Hearing.
If there is no such trademark opposition in your situation, you are exempt from this process.
Let’s say someone challenges your trademark and you reply within two months. The third party contesting trademark registration will then receive a receipt of your response from the Registrar of Trademarks.
Both you and the third party are required to provide proof to back up your assertions. The Registrar will hold a hearing for you and the third party after the evidence is filed in accordance with Rule 45. Rule 46 allows you to submit your proof, or you can notify the registry that you will be depending on the counterstatement that you have already filed. After hearing from all parties and reviewing the information, the Registrar will issue an order either accepting or denying the trademark application. The registration process will begin if the Registrar of Trademarks approves your trademark application.
A Trademark Registration Certificate is issued.
In the event that no objection is raised within the allotted time, which may vary, or after a trademark opposition hearing, the Registrar will accept your trademark application. Wow! You can use the registered trademark sign (®) beside your brand name as soon as you acquire your certificate.
